Commission Form

Terms & Conditions

last updated: 4/27/2022 (added #7 under General re:no nfts, ever, for any reason)

  • By requesting a commission, you certify that you have read, understood, and agreed to my ToS.
  • Commission requests can be made through my google form. Please direct any questions to kayzowl@gmail.com.

General
  1. I have the right to refuse any commission request for any reason without explanation.
  2. I may sometimes post a wip (work-in-progress) or stream commissions. If you do not want your commission shown publicly, or want to wait until a certain date for it to be shown publicly, please alert me.
  3. Clients will receive an email update on the commission during the wip stage if they’ve asked for one, or otherwise when necessary. Clients are encouraged to check in for updates, assurance, reminders, or questions. Turnaround time can be anywhere from a week to two months.
  4. I reserve the right to post all commissioned work on any of my personal websites and social media. For time-sensitive work (birthday gifts, anniversaries, etc.) I may delay public posting at your request.
  5. I retain all the rights to the commissioned artwork, including the right to make prints and merchandise for sale, to include it in image packs, and to alter the commissioned work to make it more generic for print, if I choose. The purchase of image rights can be negotiated for an additional fee.
  6. Clients retain all rights to their own characters. This does not mean you own the copyright to the image (see point 4). Clients may not profit from commissioned artwork under any circumstances. This includes the sale of the digital file in image packs, as prints, merchandise, for use as NFTs, etc. Clients may utilize the art for personal use (for example, print it out to display in-home or as gifts). Clients may also crop the artwork to create icons, wallpapers, or other graphics to be used non-commercially, but may not alter the artwork itself. You are free to showcase the artwork on your personal website or gallery, although I would appreciate being credited as the artist.
  7. I will not do NFTs, at all, for any reason. I do not allow my art to be made into an NFT.

Payment
  • Payment is due after details have been established and a price agreed to. I will send an invoice that must be paid in full before I will begin the commission. Payment plans are available for commissions at my discretion.

Revisions and Delivery
Clients will have the opportunity to direct revisions of their commission during the sketch/thumbnail stage. I will do my best to accommodate changes, but repeated requests for revisions, or extensive requests that diverge from the original description or references may incur additional fees.

For all commissions, minor revisions can be made after the work is complete. Major revisions may incur separate fees.
  • Minor revisions: changes to hands or feet, changing facial expressions, small accessories like jewelry, adding small, simple markings.
  • Major revisions: changes to position of limbs or torso, adding new clothing, significant changes to markings (e.g. changing a large tattoo or pattern).
To ensure a straightforward transaction process and to avoid revision fees, please make requests for specific dimensions - such as 11x17" poster size, or a square image for a button or avatar - as early as possible, where applicable.

Refunds, Cancellations, and Refusals

General refund rules:
  • If the client cancels their commission during or after payment, but before work has begun, they will get a full refund.
  • If the client cancels after work on the commission has begun, or after the commission is complete, no refund will be issued.

If I am the one to cancel the commission, 100% of the payment will be refunded to the client. I may cancel and refund a commission for any reason, including but not limited to: rude or inappropriate behavior, poor communication, or unforeseen inability to complete the commission.

Even for commissions that are not cancelled, I may recycle sketches/thumbnails that were rejected by the client for other works.
